Mediation Rate

  • Hourly Rate: $350 per hour + GST

  • Our hourly rate covers mediation services, including time spent during sessions as well as any required work required to prepare or create documentation.

Retainer

A retainer is required to secure our services and must be paid before mediation begins.

  • The retainer amount will be determined based on the estimated scope of the mediation process and will be discussed during your initial consultation.

  • Any unused portion of the retainer will be refunded promptly upon the conclusion of our services.

  • Virtual mediation enables you to connect with experienced mediators from the comfort of your home, eliminating the need for travel and saving you valuable time 

  • Yes. We understand busy schedules and our team of skilled mediators is able to book virtual meetings in the evenings and weekends to work with you and make sure you get the service you need.  

  • Mediation is confidential and without prejudice. This means that the discussions had at mediation can not be used in court at a later date. However, keep in mind that mediation is a respectful and safe space. 

  • SL Mediation functions remotely to allow parties from across Alberta to access these mediation services. Virtual mediation also allows the parties to resolve their family matters without having to physically be in the same room. However, if both parties agree, mediation can take place in Calgary at the Stokes Law offices.

  • If you think mediation should be terminated or suspended for any reason, let the mediator know immediately. Mediation is a voluntary process and we will only commence and continue with mediation if both parties are on board.  

  • When parties resolve their family matters, the mediator will draft up a separation agreement reflecting the resolution. Both parties will then take this separation agreement to their individual lawyers in order to review and sign the agreement. Once both parties execute the agreement with their lawyers, the agreement will be considered binding.  

  • Do not feel pressured to settle. Non-settlement is not a failure. Embrace the opportunity to be actively involved in a process that helps you test your own perspective on how the issue(s) may be resolved, to gain a better understanding of the other party’s version of the case, to vent your feelings about the dispute and its effect on you, to identify your interests and understand the other party’s, and to explore and evaluate the various options for settlement. If settlement is not reached and the mediator believes that another mediation session will be productive, a follow-up session will be scheduled. 

Most mediations are made up of four steps, but the process is fluid and steps can be intertwined. 

Step 1

You will provide your perspective on the facts of the dispute and so will the other side. The mediator may ask questions in order to make sure he or she has a full understanding of the dispute.

Step 2

The mediator tries to elicit a better understanding of what the real issues are for the parties. A major part of this exploration is to gain an understanding of what you and the other person(s) really want as an outcome. The mediator wants to identify your interests and to see if there is some common ground. There may be non-legal and non-monetary remedies you want.

Step 3

All parties explore options for settlement. This is an opportunity to brainstorm any and all possible opportunities for resolution. The mediator encourages discussions that consider a range of options and ways to assess whether or not they are suitable for you and the other party (parties). The ultimate goal is to identify a mutually acceptable resolution, if possible.

Step 4

The agreement is finalized in a document that is binding and eforceable, like a contract or court order, after signing the draft agreement with independent legal advice.
